The Child Care Licensing Program licenses both Child Care Centers (CCCs) and Family Child Care Homes (FCCHs) in California. Child Care Centers are usually located in a commercial building and Family Child Care Homes are in a licensee’s home. Only non-medical care and supervision can be provided in child care facilities and care is limited to periods of less than 24 hours.

The Child Care Licensing Program ensures that child care facilities operate according to the California Health and Safety Code and Title 22 of the California Code of Regulations in a number of ways:

1. You must attend an orientation.

Orientations are offered online and in-person. In-person orientations are scheduled on a regular basis throughout California.

There is an orientation fee and it is nonrefundable, so be sure that you meet the qualifications for a license before you sign up for an orientation.

You may sign up for an online orientation, or an in-person orientation by contacting your local Regional Office. The Regional Office directory will show you what counties each Regional Office covers. To see an orientation schedule for your area, click here: Orientation Schedules.

2. You must be familiar with all Child Care Center licensing laws and regulations.

3. You must complete and submit all the information and forms required in the application packet.

We will not accept your application until after you have completed the orientation. There is an application fee that is nonrefundable.

Occupational safety in preschool educational institutions, kindergarten

The work of the staff of kindergartens and other facilities for preschoolers involves a serious amount of responsibility. Parents entrust the health and even the lives of their children to the employees of these enterprises, and they are obliged to take all measures to ensure their safety while under the supervision of trained personnel.

In 2022, work on the safety of workers includes three main areas:

providing safe working conditions; nine0008
timely implementation of training;
monitoring compliance with labor safety rules.

To ensure the most effective three-step OSH control in kindergarten, strict adherence to safety standards by the employees themselves is required. Indeed, in this situation, kindergarten employees are obliged to act according to the same principle that operates in an emergency situation during a flight: first you need to take care of yourself, and only then about the child. This strict rule has a specific rationale: an adult, being in a normal physical condition and possessing the required skills to act under force majeure circumstances, can help many children, while a child of preschool age is unlikely to be able to help an adult. nine0003

Responsibility for labor protection in kindergarten

The main responsibility for labor protection of personnel of the municipal preschool educational institution in accordance with applicable law rests with the head. Therefore, it defines the main parameters of the system of measures for each of these areas, as well as the composition of the employees who will be responsible for their implementation, and their functions.

Article 217 of the Labor Code of the Russian Federation indicates that kindergartens with more than 50 employees must have a staff unit of an occupational health specialist or a specialized service. Considering that the operation of the kindergarten involves the participation of a significant number of employees - from janitors to medical staff, many of them fall into this category. If the number of employees assigned to a kindergarten is less than 50 people, the decision on whether an occupational safety engineer is needed in a preschool institution is made by its head and is fixed by the regulation on the labor protection service. However, often the manager introduces the necessary staff unit. This decision is actually justified: after all, only a trained occupational safety specialist can provide a sufficient level of security for the entire institution. nine0003

OT normative base for a preschool institution

The list of labor protection rules is regulated at the federal level. The list of main regulatory documents that regulate the functions of authorized persons on topics related to labor protection includes:

Labor Code, including Chapter 52, dedicated to the work of teaching staff;
Federal Law No. 273-FZ of December 29, 2012, establishing the principles of state policy for educational activities; nine0008
Federal Law No. 69-FZ dated December 21, 1994, on fire safety issues;
Federal Law No. 384-FZ dated December 30, 2009, which is a national technical regulation that establishes safety requirements for buildings, structures and structures;
Federal Law No. 426-FZ of December 28, 2013, which defines the principles for performing a special assessment of working conditions;
Federal Law No. 125-FZ of July 24, 1998, which defines the rules for organizing an accident insurance system and detecting occupational diseases. nine0008

In addition to the above federal regulations, this area also has a variety of GOST standards, guidelines, SanPiNs and other legal acts. In addition, it must be taken into account that directors of kindergartens are required to be guided by the requirements of professional standards for the categories of workers in question. Occupational standards have already been developed and have begun to operate, to be applied for the following professions and specialties of workers:

teacher or educator working in the field of early childhood education; determined by order of the Ministry of Labor of October 18, 2013 N 544n;
educational psychologist; determined by order of the Ministry of Labor dated July 24, 2015 N 514n;
teacher of additional classes for preschoolers; determined by order of the Ministry of Labor of September 22, 2021 N 652n;
parenting specialist; determined by order of the Ministry of Labor dated January 10, 2017 No. 10n.

Finally, kindergarten employees are required to comply with the requirements established by local regulations on labor protection - for example, orders or regulations, as well as an agreement on labor protection or a collective agreement, if one exists at the enterprise. nine0003

Occupational safety management system

Managing the personnel safety system of the preschool educational institution is the responsibility of the head, but the work on the practical implementation of functions related to labor protection is assigned to all personnel. Each employee performs his part of the powers in accordance with the current rules and job responsibilities for labor protection of existing employees of the kindergarten. For example, an electrician deals with the safety of electrical equipment and networks, a teacher monitors compliance with safety regulations and draws up a corner on topics related to labor protection. Taking into account the official duties of employees, they are trained on topics related to labor protection and related areas. nine0003

Article 212 of the Labor Code of the Russian Federation states that the employer is obliged to provide all employees with safe working conditions and health protection. One of the main ways to ensure these conditions is the provision of the necessary information at the stand on labor protection and the timely organization of training on the correct performance of work duties. For preschool educational institutions, such training is carried out by conducting OSH briefings for employees. However, according to the provisions of Art. 214 of the Labor Code of the Russian Federation, employees are required to be instructed in the labor protection training program provided by the employer. nine0003

Labor protection training for employees

The procedure for training personnel on topics related to labor protection is regulated by the provisions of Government Decree N 2464 of December 24, 2021. The regulatory document in question indicates that one of the main forms of necessary training for employees is instructing. All employees of the kindergarten are required to take these classes, including those who work on a short-term contract or perform seasonal tasks. At the same time, depending on the specific circumstances, employees are required to undergo different types of briefings:

water briefing on topics related to labor protection - upon admission to work. It provides the staff with a general idea of the safety requirements in force in the enterprise;
primary - before admission to independent work. This type of training is carried out at a specific workplace so that a specialist can get acquainted with its features and understand in what conditions he will have to work and ensure labor protection;
repeated - after six months from the date of passing the introductory briefing. The main purpose of this briefing is to update the knowledge related to labor protection that employees have; nine0008
target - if it is necessary to involve employees in the performance of special types of work that require additional security skills;
extraordinary - in the event of special circumstances. For example, this type of training is organized if the rules of the legislation in the field of labor protection have changed or an accident has occurred at the enterprise.

Lectures on labor protection for employees of preschool educational institutions are carried out using instructions specially drawn up for a particular situation. The instructions under consideration must fully comply with the current legislation in this area, as well as reflect the requirements contained in the labor protection rules and the norms related to the labor protection of women in kindergarten. When compiling them, experts advise to be guided by the methodological recommendations of the Ministry of Labor, approved on May 13, 2004. nine0003

Occupational safety instructions

More often, the development and compilation of instructions for employees is entrusted to a full-time occupational safety specialist. These documents are developed separately for each job position and each type of briefing - for example, you will need both an instruction on labor protection for the head of the preschool educational institution and an instruction on labor protection for the watchman of the preschool educational institution. At the same time, serious attention should be paid to the storage of these important documents, since, taking into account the chosen approach, there will be a lot of them in the enterprise. Often they are divided according to one of two criteria:

according to the position of employees. If this method of storing documentation is used, one storage contains grouped documents for performing different types of briefings for one profession or specialty;
according to the type of work performed. This method requires the joint storage of instructions describing the safe ways for employees to operate different types of equipment, for example, refrigeration or cooking, perform certain activities, such as sports or laundry, and so on. nine0008

The content of the document must reflect the features of the work performed, as well as the employee's professional risks in labor protection. Despite the fact that the composition of measures and requirements for each instruction varies significantly, they often have a typical structure. The standard instruction on labor protection for a preschool teacher or other employee contains the following blocks:

general labor protection standards for the profession or type of work in question;
procedure for a specialist before starting work, ensuring labor protection; nine0008
safety rules in the performance of official duties;
post-work order;
rules of conduct in case of emergency or force majeure.

Conducting and preparing briefings

The direct supervisor of employees is entrusted with carrying out briefings on topics related to labor protection. His candidacy is approved by a separate order of the head of the preschool educational institution, which fixes the rights and obligations of the instructor during classes. At the same time, in order to be allowed to conduct the required classes, the instructor must himself undergo OT training and knowledge testing. Often, the heads of preschool educational institutions turn to authorized training centers for this, which provide the necessary training on a professional basis. After that, he is allowed to independently conduct classes for subordinates. At the end of the training, he also makes an oral check of the knowledge they have acquired. nine0003

Information about the briefings carried out is entered into a special log. This is done in order to fix the date of the organization of a particular type of event and guarantee their timely implementation in compliance with current requirements. For example, re-briefing should be organized after six months from the date of entry to work. At the same time, of course, the required dates for the re-briefing will differ for different workers who were employed in a particular kindergarten at different times. In order to track this data, this log is needed. In addition, the information entered in this document can be checked by the labor protection commission during the audit. nine0003

Journals on labor protection in preschool educational institutions

According to Decree No. 2464, the implementation of all types of instructional classes must be recorded in a special journal. The forms of the documents under consideration are fixed by the interstate standard GOST 12.0.004-2015, which contains the current labor protection standards for employees of organizations. A standard sample log for each type of briefing contains the following information:

date of organization of the training event;
last names, first names and patronymics of trained employees;
years of their birth;
professions, specialties or positions held;
name of the division of the organization where employees will work after the briefing;
surname and initials of the specialist who performed the briefing;
signatures of employees who have been instructed on topics related to labor protection.

At the same time, the use of the provisions of GOST 12.0.004 2015 when issuing instructional journals is advisory. If necessary, the employer can make changes to the proposed forms. nine0003

Work plan for labor protection in the preschool educational institution

Plan of measures for the labor protection of employees of the preschool educational institution is a system document that contains a list of all types of work of the organization in this area. The whole set of measures that is reflected in this plan is usually divided into three major categories:

registration and work with documentation on labor protection and work process safety;
achievement of the required level of safety of the educational process and related types of work;
improvement of working conditions for employees of a preschool organization.

This document is usually compiled for a specific time period - most often one year. Upon completion, the content of the plan is revised to remove irrelevant tasks from it and to include information that reflects the new OSH standards. At the same time, a comprehensive annual plan may contain data broken down into internal time periods - for example, a quarter or a month. This will allow more carefully and quickly control the sequence of necessary actions according to the report on labor protection in the preschool educational institution. nine0003

The plan is drawn up by a labor protection specialist based on the order of the Ministry of Labor dated October 29, 2021 N 771n. It contains a list of typical measures that employers should take to improve the working conditions of employees on a regular basis. After drawing up the plan, it is submitted for approval to the head of the preschool educational institution.

Carrying out a special assessment of working conditions

Preschool organizations are included in the list of enterprises that are required to carry out a special assessment of working conditions in accordance with Federal Law No. 426-FZ of December 28, 2013. This procedure is a comprehensive check of the conditions at the workplace of employees, as a result of which they are assigned one of four hazard classes:

optimal (class 1) - the impact of harmful factors of the production process on workers does not exceed the permitted standards;
permissible (class 2) - the impact of harmful factors is present, but the employee manages to fully restore the normal state by the beginning of the next work shift without additional measures;
harmful (class 3, divided into 4 subclasses based on the level of harmfulness) - the impact of harmful factors is strong enough to ensure a violation of the worker's ability to work and the likelihood of him developing occupational diseases; nine0008
hazardous (class 4) – exposure to harmful factors threatens the employee's life.

The normative document under consideration indicates that the employer is not entitled to independently carry out the SOUT in the preschool educational institution: for this he must involve an authorized organization included in the register of the Ministry of Labor. In practice, the places of employees of child care institutions in most situations are assigned an acceptable or optimal class. Under these conditions, the employer may prepare and submit for consideration the territorial division of the State Labor Inspectorate a special declaration. It will serve as documentary confirmation of the fact that working conditions in these places comply with state standards. nine0003

The execution of the declaration in question has a serious plus: despite the fact that formally its validity is five years, after this time period it is automatically extended. This means that organizations that have only workplaces classified as optimal or acceptable do not need to re-conduct the SOUT and study labor protection at the enterprise every five years. However, the simplified procedure under consideration has a significant limitation: it is used only if, during the period of validity of the declaration, the children's organization did not have any accidents, no occupational diseases were detected, or situations where the norms related to labor protection of workers were violated. If such an incident occurs, the declaration is automatically terminated, and the preschool educational institution will need to conduct an extraordinary special assessment by checking labor protection. nine0003

Pupils of the Veterok group (3-4 years old) took part in the Olympiad according to the rules of the road for pupils of preschool educational institutions as part of the International Olympiad "Globus".

Initiation into the YID squad (September 2022)

On September 22, in a solemn ceremony, the initiation of pupils of the Zorenka and Constellation groups into the Svetofor squad of young traffic inspectors took place. The ceremony was held with the participation of traffic police officers, cadets of the traffic police detachment "Road Patrol" and the Parent Patrol of the kindergarten "Solnyshko". Each child was given a personal certificate confirming that he is a member of the UID squad. The cadets reminded the children about the rules of the road for pedestrians.To complete practical tasks, the children used an interactive whiteboard and a lapbook.At the end, the preschoolers with the cadets made reflective pendants.All the participants of the lesson received themed booklets and coloring books as a gift.

Parents’ meeting (September 2022)

talked about the need to use seat belts and child restraints when transporting children in a car, safe cycling, the mandatory use of reflective elements by minor pedestrians and answered all the questions of parents. nine0003

On June 1, the "Giving Children Childhood" holiday was held on Sovetskaya Square, dedicated to Children's Day, the program of which included games by stations. It was entrusted to organize the work of one of the stations called "Road Patrol" to teachers and the assets of the Parental Patrol of the "Solnyshko" kindergarten. Together with the traffic police inspectors, they prepared tasks for the children: correctly place the signals at the traffic lights, assemble a road sign from cubes and name the road signs depicted on the plates. On May 26, the Parental Patrol of the kindergarten "Solnyshko" took part in a large-scale outreach campaign "Parents Patrol", timed to coincide with Children's Day. Together with the children of all age groups, parents in a playful way repeated the rules of safe behavior on the road. Then the activists of the Parents' Patrol, together with the traffic police inspectors, talked with drivers about the need to comply with the rules for transporting children in a car. Regional large-scale campaign "Pedestrian! Attention! Crossing!" (March 2022)

On March 17, parents, teachers and traffic police inspectors took part in the regional large-scale campaign “Pedestrian! Attention! Transition!". Before the start of the preventive raid on the pedestrian crossing, the Parental Patrol, together with the children, repeated the rules for crossing the road with the children attending the kindergarten - they answered all questions with pleasure and received reflectors as a gift. nine0003

The Resource Center for Road Safety Prevention brought together teachers from preschool educational organizations to share experiences. Senior teacher Kokueva O.V. told at the seminar "Modern means of teaching and educating children to be safe on the road" about the everyday life of the "Parents Patrol".

Large-scale propaganda and information campaign "Straighten the most expensive"

(December 2021)

Activists of the Parents' Patrol joined the large-scale propaganda and information campaign "Straighten the most expensive" held in the Yaroslavl region: in the courtyard of the garden, led by the main winter wizard, they reminded the rules of safe participation in traffic for adults and children. Road Safety Day (September 2021)

On September 23, the United Day for Road Safety, the educational activities of the pupils of the kindergarten "Solnyshko" were devoted to the study of the rules of the road. On April 1, the Parental Patrol, together with the traffic police inspectors, carried out a promotional campaign "Child is the main passenger", aimed at preventing road traffic injuries involving child passengers. Parents and inspectors urged drivers to use a child car seat when transporting a child, to be careful on the road. Some drivers readily demonstrated the child restraint in their vehicle. Inter-municipal creative festival for the prevention of children's road traffic injuries "Give Good" (February 2021)
