How to Deal With Your Boss When Your Child Is Sick | Work
By Leslie Bloom Updated September 24, 2018
It’s 6:30 a.m. and your toddler has a runny nose, watery eyes and her temperature is spiking. You know you must keep her home from day care, which means missing work. You don’t want to have to call or email your boss about your sick child yet again, but you know you have to. Ideally, you already know your employer's policy on missing work to stay at home and care for your sick child before the situation happens. Whether it is the first or the 10th time you have had a sick kid excuse for work, there are ways to deal with your boss when your child is sick.
Call or Email Your Boss
Contact your boss and tell him that your child is ill and is unable to attend day care or school and you need to stay home with him. It is not necessary to go into detail about your child's illness unless your boss asks for specifics.
Example:
Hi Chris. I am so sorry to do this, but my daughter is sick, and I need to take the day off to take care of her.
Plan for How to Cover Your Responsibilities
It may be stressful for both you and your boss if you need to complete a task or have a meeting scheduled that day. When you contact your boss, let her know how you will cover your day’s responsibilities. Your plan could include calling a co-worker and asking him to cover specific tasks for you. Or, you could ask your boss or a co-worker to email you information that will help you complete your work from home.
Examples:
I know I have a meeting with the event team to plan next month’s networking lunch. I can call into that meeting at the scheduled time so that we don’t have to reschedule it.
Today is the day I am supposed to get you the final projections for the third quarter. My assistant has the file and can finish the calculations, so you will still have it by the end of the day.
Stay Connected
Even if you cannot physically be in the office, you can stay connected via email or phone so that you do not miss too much work due to your sick child. Only suggest this to your boss if you think you will have time while tending to your child.
Example:
I know I can’t be in the office, but I can be available throughout the day. If something is urgent, please email or call me.
Estimate Your Absence
Inform your boss if you think you will need to be at home for more than one day, in those cases when your child has a serious illness. Be prepared to explain why you cannot make other arrangements if your son or daughter is sick.
Example:
It looks like my son has the flu, and I will need to stay home from work for a few days. He’s not allowed to attend day care while he has a fever. His grandmother usually watches him when I can’t, but I don’t want to expose her to this nasty virus.
Get Acknowledgment From Your Boss
When you call or email your boss about your sick child, be sure to ask for a response so that you know he received your request. If you had a conversation with him already, then you are in the clear.
Example:
Please let me know you received this message and are not wondering why I am not in the office. Thank you!

Tips
- Tell your boss that you will come to the office after hours and work if necessary, once your spouse comes home or a family member or friend is available to care for your child.
- In some cities, parents can find day care services or nannies for sick children.
- If a whole day off isn't a possibility due to pressing work responsibilities, ask your spouse or partner if he will split the task of caring for your sick child with you, so you both can spend some of your day at work. For example, he could stay at home in the morning while you go to work, then you could come home at noon and allow him go to work.
Warnings
- Think of your plan to cover your work before you call your boss to tell him you need to stay home. If you call unprepared, it might seem as if you aren't concerned about your work responsibilities.

step-by-step instructions in 2022
An employee brought a sick leave, but he did not get sick himself, but looked after the child. There are some peculiarities when assigning temporary disability benefits
The main rules of an accountant
- Assignment and payment of benefits for caring for a child are made in full (from the 1st day of disability) at the expense of the Social Insurance Fund (part 3 of article 3 of Federal Law No. 255- FZ). The employer is not obliged to pay at his own expense for the first three days of incapacity for work.
- The amount and procedure for assigning temporary disability benefits depend on the age of the child, type of disease, place of treatment of the child (part 5 of article 6 of the Law of December 29, 2006 No. 255-FZ).
- Sick days for childcare falling on annual leave are not paid. The sick leave benefit is due from the day the employee was supposed to go to work (Article 9 of Law No. 255-FZ). They pay only those days of temporary disability that fall on the days after the end of the annual leave.
Assignment of benefits in 2022. Algorithm for the interaction of the employer with the Social Insurance Fund
From January 1, 2022, the procedure for the employer to transfer information to the FSS of the Russian Federation for the appointment and payment of temporary disability benefits is regulated by Decree of the Government of the Russian Federation dated November 23, 2021 No. 2010.
- You need to look at the information in the service of electronic interaction with the Social Insurance Fund - "Social Electronic Document Management" (SEDO). This service is integrated into accounting programs.
- If there is information about the closure of the sick leave, then within 3 working days, upon request, the employer must transfer information for the payment of benefits to the FSS of the Russian Federation. The list of information provided to the FSS of the Russian Federation is named in paragraph 22 of the Decree of the Government of the Russian Federation of November 23, 2021 No. 2010. The employer provides the Fund only with the information that will be indicated in the request. If the FSS of the Russian Federation has the information necessary for him to assign benefits, they are not requested from the employer.
- Within 5 working days, if necessary, a specialist of the FSS of the Russian Federation may request from the employer additional information for assigning benefits, for example, information about the regional coefficient.
- If an FSS request for additional information is received, the employer must:
- within 3 working days to confirm that he received the request;
- within 5 working days to provide additional information.
From January 1, 2022 , the term for payment of by the territorial body of the FSS of the Russian Federation the amount of temporary disability benefits is 10 working days from the date of receipt of information , which is necessary for the appointment and payment of benefits.
At the end of the article there is a cheat sheet
The number of days of disability that can be paid
The number of days of disability that will be paid to the employee depends:
- on the age of the child;
- from the type of child's disease;
- from the place of treatment of the child: outpatient or inpatient.
V st. 6 of Federal Law No. 255-FZ of December 29, 2006, specifies the conditions and duration of payment of temporary disability benefits, including in the event that the employee was caring for a child. Let's look at them in a table.
Child's age | Number of paid days | Restrictions | Disability reason code | Features |
---|---|---|---|---|
Up to 7 years | The entire period of disability, regardless of the place of treatment (outpatient or inpatient) | No more than 90 calendar days in a calendar year for all cases of care for this child | "12" | The disease is included in the list, approved. Order of the Ministry of Health and Social Development of the Russian Federation dated February 20, 2008 No. 84n |
No more than 60 calendar days in a calendar year for all cases of care for this child | "09" | |||
7 to 15 years | For a period of up to 15 calendar days for each case of outpatient or inpatient treatment of a child | No more than 45 calendar days in a calendar year for all cases of child care | ||
15 years and older | No more than 7 calendar days for each case of the disease when treated on an outpatient basis | No more than 30 calendar days in a calendar year for all cases of care for this child | ||
Under the age of 18 in case of caring for a sick disabled child | The entire period of disability, regardless of the place of treatment (outpatient or inpatient) | No more than 120 calendar days in a calendar year for all cases of care for this child | "13" | |
Under the age of 18 with his disease associated with a post-vaccination complication, with malignant neoplasms | The entire period of disability, regardless of the place of treatment (outpatient or inpatient) | "14" | ||
Under the age of 18 if the child is HIV positive | The entire period of incapacity for work (only in a hospital) | "15" |
Attention : the legislation of the Russian Federation does not regulate the issue of who should count the days of temporary disability for caring for a sick child for the corresponding calendar year.
Opinion of the FSS of the Russian Federation: accounting for the number of days for which an employee must be paid temporary disability benefits due to the need to care for a sick child is the responsibility of the employer (Letter of the FSS of the Russian Federation dated 19.12.2014 No. 17-03-14/06-18772).

Advice to the employer: how to take into account and control the number of days used to care for a sick child:
- keep a special registration log in a form convenient for him; or
- keep track of such days in a table (for example, in Excel).
The amount of temporary disability benefit
From 09/01/2021, the amount of temporary disability benefit depends not only on the employee's length of service, but also on the age of the child. The procedure for determining the amount of benefits is given in Art. 7 of the Federal Law of December 29, 2006 No. 255-FZ.
- Situation 1. The sick child is under 8 years of age. The entire period of disability is paid to the employee based on 100% of average earnings. The length of service of the employee does not matter here.
- Situation 2. Age 8 years and older (Part 3 of Article 7 of Law No. 255-FZ dated December 29, 2006):
- when treating a child on an outpatient basis, the first 10 calendar days of incapacity for work are paid in the amount determined depending on the duration of the employee's insurance period, and the following days - in the amount of 50% of the average earnings;
- when a child is treated in a hospital, the allowance is paid in the amount determined depending on the duration of the employee's insurance period.
When treating a child aged 15 years and older as an outpatient, the allowance is paid for no more than 7 calendar days in an amount depending on the duration of the insurance period.
The amount of average earnings depending on the insurance period of the employee (Part 1, Article 7 of the Law of December 29, 2006 No. 255-FZ):
Example
Vera Lozhkina works at Progress LLC. From August 18 to August 31, 2022 (14 calendar days), she was on sick leave to care for a child who is 9 years old.
In 2022, Lozhkina was already on sick leave to care for this child:
- from March 10 to 16 - 7 days;
- from 4 to 20 April — 17 days;
- from 14 to 29 June - 16 days.
By August 18, the total number of benefit days since the beginning of the year was 40 days (7 + 17 + 16). Pay only 5 days (45 - 40 days).
- Vera Lozhkina will be paid for the first 5 days of incapacity for work (from August 18 to 22) depending on her length of service, but the remaining 9 days (from August 23 to 31) will not.

Memo to parents about sick leave
Parents about sick leave.
In accordance with the order of the Ministry of Health and Social Development of June 29, 2011 No. 624n. "On approval of the procedure for issuing sick leave certificates" this document for caring for a child is issued to one of the family members (guardian, custodian, other relative). It is important that he actually takes care of the sick child. A relative who receives an exemption from care work is not required to confirm the fact of his relationship with him. A disability certificate for child care can be issued to different family members alternately, within the established time limits
- A certificate of incapacity for work for child care is opened on the day of visiting a doctor. "Backdating" sick leave does not open. Therefore, if you need a release from work, inform the doctor about it in a timely manner, on the day of the first appeal, and not on the day of discharge.
- In the event that two children fall ill, the data for both are entered in the "Care" line, and if there are three children or more, a new sick leave is issued, since the form provides space for only two surnames.
- In a situation where a child under 3 years old is sick or a disabled child under 18 years old and the mother at the same time, then sick leave can be issued to any other working family member for the period of the child’s illness
- A certificate of incapacity for work is issued upon presentation of an identity document No. 624n)
- In the case when a citizen caring for a child is employed by several employers and was employed by them for the previous two years, several certificates of incapacity for work are issued, if part-time for less than 2 years - a photocopy of the sheet is submitted to the second place of work disability, certified by the employer at the main place of work.
- A certificate of incapacity for work is issued after an examination of a sick child, to a person who will provide care and is present at the examination. It is prohibited to issue and extend a certificate of incapacity for work to a person who is absent during the inspection period. If a doctor came to the child, the mother needs a sick leave, but she is not at home at the moment, the doctor does not have the right to issue a sick leave in the name of the absent mother. Mom will have to come to the pediatrician’s appointment on the same day to issue a form of exemption from work, otherwise the document will be written out from the day when the mother came to the pediatrician’s appointment.
- For all examinations to the doctor, the child must be accompanied by a relative who has a certificate of incapacity for work to care for the child. In the absence of an appointment (home visit) of a person who has been issued a sick leave for care, the doctor has the right to make a note on the disability certificate about “violation of the regime”. Such sick leaves are paid at the rate of the minimum wage.
- "Violations of the regime" also includes non-fulfillment of doctor's prescriptions and untimely (not on the appointed day, time) attendance.
- If the child receives treatment in different medical institutions for health reasons, then the mother (dad) must notify the doctor about a previously issued sick leave in another organization
- If the caring parent is a student of educational institutions, a certificate is issued for exemption from studies.
- During quarantine, a certificate of incapacity for work is issued for caring for a child under 7 years old attending a preschool educational institution, if the quarantine is established on the basis of a decision of the Government of the Russian Federation, or a local government body, or a decision of authorized officials of the federal executive body, or its territorial bodies (clause 43 of the order dated 2906. 06.2011 No. 624n)
Certificate of disability for caring for a child in 2015 is not issued:
- When treating a child over 15 years old in a hospital;
- If the child falls ill during the parent's annual paid leave;
- When the child was ill during the parent's "own-account leave";
- If the mother was on maternity leave, parental leave
- If the caring adult is registered with the state employment service
- For chronic patients in remission.
- For the period of sanatorium treatment, including a disabled child
With regard to these holidays, it is important to remember that sick leave for child care can be issued from the date following the end of the vacation, if the need to care for a sick child has not disappeared.
On the duration of incapacity for work
- The doctor has the right to single-handedly issue and extend the sick leave for caring for a child for a period not exceeding 15 calendar days during one case of illness. For further release from work, a conclusion of a medical commission is required.
- According to par. 5 and 6 Art. 6 of the Federal Law of December 29, 2006 No. 255 - FZ establishes the following duration of payment of temporary disability benefits when caring for a sick family member:
For the entire period of outpatient or inpatient treatment. But during the calendar year, the period of being on "sick leave" in total should not exceed the paid period (clause 35 of the Procedure, approved by order of the Ministry of Health and Social Development of Russia dated June 29, 2011 N 624n) and (clause 1, 3, part 5, article 6 of the Federal Law from 29.12.2006 N 255-FZ).
If the number of paid days in a year exceeds the established norm, a certificate (not paid) is issued, or a certificate of incapacity for work can be received by another family member who also has the right to care for the child.
On payment of a sick leave for child care in 2015
If the child is treated on an outpatient basis (that is, at home), then the first 10 days of sick leave will be paid depending on the insurance record of the relative who is caring for him.
